DSP Professionals Pvt. Ltd.

1. Introduction

DSP Professionals Pvt. Ltd. (“DSP Professionals”, “we”, “our”, or “us”) is a recognized Insolvency Professional Entity (IPE) empanelled by NCLT and operating under the Insolvency and Bankruptcy Code, 2016.

This Refund Policy outlines the terms governing professional fees, payments, and refund conditions related to services rendered by the firm.


2. Nature of Services

DSP Professionals Pvt. Ltd. provides professional insolvency, liquidation, restructuring, and advisory services under the Insolvency and Bankruptcy Code, 2016.

These services include, but are not limited to:

  • Interim Resolution Professional (IRP) assignments

  • Resolution Professional (RP) services

  • Liquidation proceedings

  • Bankruptcy Trustee services

  • Restructuring advisory and compliance support

Professional services are rendered only upon formal engagement and subject to regulatory approval where applicable.


3. No Online Product Sales

DSP Professionals Pvt. Ltd. does not sell physical or digital products through its website.

The website is for informational and enquiry purposes only. Payments, if any, are governed by formal engagement terms and regulatory guidelines.


4. Professional Fees & Payments

Fees for professional services are:

  • Agreed upon through written engagement

  • Structured in accordance with applicable regulatory provisions

  • Subject to approval of Committee of Creditors (where applicable)

  • Governed by statutory fee frameworks under IBC and IBBI regulations

Payment terms are defined in formal engagement documentation.


5. Refund Eligibility

Refunds, if applicable, shall be governed by the terms agreed upon in the formal engagement letter.

Generally:

  • Fees paid for services already rendered are non-refundable

  • Retainer or advance fees may be adjusted against work performed

  • Refunds, if considered, shall be at the sole discretion of DSP Professionals Pvt. Ltd., subject to contractual terms and regulatory provisions

Statutory assignments under IBC may have fee structures governed by regulations and creditor approvals.


6. Regulatory Assignments

In cases where DSP Professionals Pvt. Ltd. acts as:

  • Interim Resolution Professional

  • Resolution Professional

  • Liquidator

  • Bankruptcy Trustee

Fee structures may be determined in accordance with:

  • Insolvency and Bankruptcy Code, 2016

  • IBBI regulations

  • Orders of Adjudicating Authority (NCLT)

  • Committee of Creditors approval

Refunds in such assignments are subject to statutory and regulatory provisions and not solely discretionary.


7. Cancellation of Engagement

Cancellation of a professional engagement must be made in writing.

Any refund or adjustment will depend on:

  • Work already performed

  • Regulatory compliance requirements

  • Contractual terms agreed upon at the time of engagement

DSP Professionals Pvt. Ltd. reserves the right to deduct fees for services rendered prior to cancellation.


8. Dispute Resolution

Any dispute regarding fees or refund claims shall be governed by:

  • Terms outlined in the engagement agreement

  • Applicable provisions of the Insolvency and Bankruptcy Code, 2016

  • Laws of India

Such disputes shall be subject to jurisdiction of courts in Maharashtra, India.
